New York Workers’ Compensation Updates

Effective January 1, 2025, the next set of increases took effect regarding the minimum benefits paid to workers injured on the job who cannot work. Now, such injured workers are entitled to a minimum of $325 per week, an increase from the rate of $275 from last year. 

All employers should check with their carriers to ensure that their workers’ compensation premiums and policies are all up to date to avoid the serious consequences that can result from failing to comply with workers’ compensation laws, which can result in personal liability. 

Additionally, employees can now file for workers’ compensation benefits for mental health injuries resulting from “extraordinary work-related stress.” In a significant clarification, workers’ compensation claims cannot be denied because the “stress was not greater than that which usually occurs in the normal work environment.”
