With elections approaching on Tuesday, November 5, 2024, New York employers must comply with the state’s voting leave law. Under N.Y. Election Law § 3-110(1), employers must provide “sufficient time” for employees to vote. However, per § 3-110(2), employers aren’t required to offer leave if an employee has four consecutive voting hours outside work hours or enough time between their shift and poll closure. New York law mandates up to two hours of paid voting leave at the start or end of a shift, with employees needing to notify employers 2 to 10 working days before the election.
Employers must also post a notice about this law at least 10 working days before each election, displayed conspicuously at the workplace until polls close. To stay compliant, employers might consider making this notice a regular part of their compliance postings.
